Sony Sued Over “Sub-1080p” Shadow Fall Multiplayer Visuals

I'm sorry, but if you're leveling a lawsuit because a video game isn't quite as beautiful as you wanted, you need to get a life. Seriously.

As GameSpot reports , a class-action lawsuit has been filed against Sony Computer Entertainment America, and it accuses the company of misleading consumers by claiming the PlayStation 4 exclusive launch title, Killzone: Shadow Fall , doesn't really produce 1080p graphics in its multiplayer mode.

Douglas Ladore filed the suit in U.S. District Court in California, and he says gamers "quickly noticed and complained that Killzone 's multiplayer graphics were blurry to the point of distraction." This is in spite of Sony's advertised "1080p multiplayer graphics, a crowning achievement in the video game industry." Ladore wants Sony to stop advertising the game as being 1080p, and he wants more than $5 million in damages.

Yeah, here's my suggestion to the judge: Dismiss the case immediately, publicly harangue Ladore for wasting the justice system's time, and make him pay for everyone's time. I'm not normally so blunt regarding news but this is downright idiotic.

Get over yourself.

I agree, this is blatant cash grab. I wouldn't doubt if this was some way for Microsoft to throw some mud on Sony's stellar PS4 launch. Conspiracy Theories FTW!!

I wouldn't doubt if you were the one who initiated the lawsuit so you could blame Microsoft for it.

Just curious, but is there anything in the Justice System which says "You must have a good reason to try to sue someone"???

Because, I mean, I can't see ANY lawyer with any kind of hope of keeping their reputation taking this case on.

In 5 seconds any person will medium level intelligence will notice that Sony never actually advertised that the game runs NATIVE 1080p, also, the advertisements never stated EVERY single part of the game runs native 1080p. You could argue the advertising is misleading, but Sony is under no obligation to point these things out.

The judge will throw this case out within moments of it opening, at least he should.

You can, but is it really worth the physical effort on your part?
I mean, you'd get one hell of a workout, sure. But still, is it truly worth it? Plus, you'd have a really painful hand afterward. :p

Hehehe, good thing no one from here is looking at the ars technica comments section, a 4chan v. Tumblr style war would start.

While we're at it, why don't we sue game developers and publishers for not releasing games when they first announce release dates? That should at least get them to stop prematurely announcing release dates…

To be fair, if Sony advertised the game as being 1080p, and made that some type of marketing statement, they are falsely advertising their product.

Still though, five million in damages? What? I mean, I get that this guy kind of has a suit against them for false advertising, but $5M? No. Just, no.

Did you guys notice the difference in graphics between TLOU on PS3 and PS4? Guess what? I couldnt. Hardly no one else did either, except the Sony dog bots.

This industry, Sony included especially, tends to EXAGGERATE what is being done, what they hope to do, and what actually happens in terms of gameplay and graphics all the time.

Sue em. I hope you win. Maybe it will teach companies to stop lying.

And "blurry to the point of distraction?" Man, what TV is he playing on because Killzone is one of the better looking, crisper games of any platform.

Except he doesn't even have a case even a 480p game that upreses itself and advertises itself as 1080p is still 1080p…. So many games did this last gen and no one got sued.

I can understand complaints about false advertisement, but $5 Million? Refund him for the game and any DLC. Heck refund the PS4 price if he bought it for the game. Then throw in another game or a year of Plus. Even with shipping and taxes it's what? A bit over $600? OK, so let's call it $625 to be safe, per person in the lawsuit. Less if nobody bough the PS4 specifically for the game (that'd be under $200 per person.) Oh, and we find out if they bought the PS4 for it before announcing the settlement.

No way enough people signed on to equal $5 Mil. And this is only if his claims can be proven. IF.

Well, I'm sure that the way these things usually work is that if the judge rules against Sony, that the ruling will be divided up amongst affected parties and the 5 million will not got to this gentleman who filed. Why is anyone even suggesting otherwise. This lawsuit is not about money but against blatant false advertising. But judging by the tone around here, seems perfectly ok for Sony to do this. Sickening.

Im pretty sure most games do state "Gaming experience may change online." Or is that just in Aus and NZ??

SirLoin of Beef
SirLoin of Beef

They state that but they're referring to interaction with people. For example, a game might be rated T but that rating is for the content they have control over. They don't have nearly as much control over what people say and talk about online, so they let people know that.

This is ridiculous pure and simple. If said person is not satisfied with the game, take the game back and get a refund. As for the 'false advertising' claims, I don't see this as a big enough issue to warrant suing.

It's not like they said it was going to be a FPS and then turned out to be a strategy game or something like that.
