But it was probably never going to happen, anyway. As various sources are reporting, including The Verge , the lawsuit between Activision and former Infinity Ward bosses Jason West and Vince Zampella has been settled out of court.
Of course, this means the case won't go to trial after both sides came to a behind-closed-doors meeting. Furthermore, Ben Fritz from the LA Times has confirmed that the case between the 40 former IW employees and the CoD publisher has also been settled. Terms of these deals remain "strictly confidential," although both Activision and EA have issued public statements. …EA wasn't technically involved in this mess but they had to say something, right?

"Activision Blizzard, Inc. today announced that all parties to the litigation have reached a settlement of the dispute, the terms of which are strictly confidential. The company does not believe that the incremental one-time charges related to the settlement will result in a material impact on its GAAP or non-GAAP earnings per share outlook for the current quarter or the calendar year, due to stronger-than-expected operating performance in the current quarter."
EA
"Activision's refusal to pay their talent and attempt to blame EA were absurd. This settlement is a vindication of Vince and Jason, and the right of creative artists to collect the rewards due for their hard work."
